Dear Sirs or Madams,
I am Greek Cypriot refugee with duel nationality who resides in the United
Kingdom and who owns property in the occupied areas,
I have been denied my entitlement to vote in the Annan plan referendum in
violation of the constitution.
I have not received any kind of ballot card or registration papers to enable
me to do vote nor is there any means by which I can register to vote.
As a property owner I have not given Kofi Annan or anyone else permission to
confiscate my property to which I have the title deeds to nor does the
Republic of Cyprus have the right to do this on my behalf or to put to the
electorate a plan which so does.
In the United Kingdom there are 350,000 other Greek Cypriots just like me
who have also been denied their fundamental rights. These people like me
have not been sent postal ballots nor can they be expected to get on a plane
and fly to Cyprus to vote on April 24 at this short notice nor could they do
so even if they wanted to, nor have they signed away their property rights
to Kofi Annan.
The Republic of Cyprus is bound by the European Convention of Human Rights
and has the duty to respect it and all of its provisions including the right
to property and the right to democratic representaion. The Annan plan forces
the Republic of Cyprus to abandon the European Convention of Human Rights
which is primary Cyprus law and it denies all Greek Cypriots access to the
European Court of Human Rights to secure their rights.
The Annan plan is clearly UNCONSTITUTIONAL and by putting this unethical
plan which violates Cyprus primary laws, the treaties it is committed to and
its constitution to the vote the republic is acting illegally. President
Tassos Papapdooulos has said exactly the same thing as I have in his speech
on Wednesday 7 April stating that he has no right to put such a plan which
violates the rights of the Cypriot people to the electorate or to support
it.
I demand that the Cyprus parliament and the Cyprus president immediately
refer the Annan plan to the Constitutional Court with the recommendation
that the referendum on April 24 be suspended indefinitely until everyone's
rights are fully secured in a new plan or that the existing plan is declared
null and voild. I also demand that legal proceedings be imitatiated against
the UN Secretary General Kofi Annan in the International Criminal Court
under Article 4 of the "Convention on the Prevention and Punishment of the
Crime of Genocide" for conspiracy to commit genocide [under Article 2(c)]
and incitement to commit genocide [under Article 3(c)] by attempting to
force the Cyprus republic to put his unethical plan which inflicts
conditions of life on the Greek Cypriots calculated to bring about their
physical destruction in whole or in part to a referendum.
